    Working in Romania

    The Romanian government has approved a law on implementing the Adequate Minimum Wages, with a view to integrating the EU directive 2041 into the national legislation. The gross minimum wages in Romania will be updated according to the purchasing power, the general level of wages and their distribution, in keeping with the wage growth rate and the labour productivity at national level.

    The law will be applied to all categories of employees.  Under the EU Directive 2041 in 2022, the minimum wage cannot be less than 50% of the gross average earnings. At present, the value of the gross minimum wage in Romania is roughly 660 Euros and is expected to rise up to roughly 740 Euros starting July 1st. The medium net wages in Romania in April stood at 1.048 Euros 6.4 Euros higher than in March, says the Statistics Institute. The highest wages were registered in the area of IT services, roughly 2.405 Euros, whereas the lowest were found in the clothing industry, nearly 560 Euros). The law, endorsed by the Executive is to be submitted for urgent Parliament approval.

    Romania’s President, Klaus Iohannis, has promulgated a law under which paternity leave will be granted to all fathers who are employees under a legal labour contract.  The document does away with the stipulations about the ensured quality of the owner within the social insurance system and introduces some provisions through which other categories of people are included, such as those with contracts for sports activities, individual labour conventions, mandate contracts, management contracts, those involved in activities following a position of public dignity and those under management and administration contracts. The paternity leave has also been extended from five to ten working days and the compensation is equal to the wages of that certain period being funded from the state budget.

    During the periods of extremely hot weather, with temperatures above 37 Celsius and a comfort index over 80, employers in Romania are taking measures to improve the working conditions and maintain the health of their employees. Territorial Labour Inspectorates say that during the periods of hot weather, employees must benefit from physical activity of reduced intensity and pace, from ventilated rooms, and whenever possible the periods of activity must include pauses in shady places. Every employee must be ensured between 2 and 4 liters of sparkling water. In order to avoid illnesses caused by work in hot weather, the personnel will undergo periodical medical examinations in order to discover the cases, which may become vulnerable in periods of extremely hot weather.  The employees in these situations will benefit from reduced working hours or are allowed to change their jobs. Any violation of the present legal regulations constitutes a contravention punishable by fines.

    According to the National Agency for Employment, nearly 44 thousand jobs are available in Romania presently. Most of the jobs are in the area of security guards, 3,099, shop assistant – 2,232 and delivery men – 1,867. Also in high demand is the unqualified personnel needed in the process of assembling and mounting parts, 1,711. Unqualified workers are also needed on various construction sites, 1,685 jobs as well as cargo handlers with 1,381 jobs available.     LAWS Parliament
    is due to convene for a new session in Bucharest on February 1. Until then, the
    Romanian MPs are working on new bills, focusing, among other things,
    on regulating gambling and curbing drug consumption. The new legislation
    includes several measures such as the relocation of casinos and betting houses
    outside towns and cities, limiting gambling commercials and banning gambling
    ads near schools, parks or hospitals. According to the authors of the bills,
    some of them introduced as early as in 2022, the amendments come in the context
    of the latest expert warnings on the
    younger generation’s alarmingly growing addiction to gambling and drug consumption
    as well as their vulnerability to various advertising campaigns. Drug
    trafficking is punished with up to 10-year prison sentences. Other draft laws ban
    minors’ access to energy drinks and restrict commercials to vaping products and
    accessories.




    INVESTMENTS
    According to data released by the National Institute for Statistics, in the
    first nine months of 2023 Romania’s construction sector reported over RON 74
    billion worth of investment, which accounts for 62.6% out of the total
    investment in the country’s economy. In the same period, investments in
    Romania’s national economy stood at roughly RON 118.5 billion, a 14.4% rise as
    compared to the period between January and September 2022.




    CYBER SECURITY A
    new EU Cyber Security Regulation has taken effect in the EU, introducing a
    minimal set of measures for public institutions in EU member countries to
    protect themselves from online attacks. In Romania, just like in most EU
    countries, the number of cyber-attacks from Russia has increased since the
    start of the war in Ukraine. Under the Regulation, an EU Cyber Security Board
    will also be set up, which will monitor the implementation of security
    measures. Member state institutions are to initiate a security enhancement
    process this year and to introduce protocols to manage information networks. Under
    the Orange Business Internet Security Report, 31% of the attacks against
    Romania targeted the energy sector, 22% transports and 19% the governmental and
    public services sector. The attacks caused losses of billions of US dollars,
    and the institutions targeted in the past 2 years include the National Cyber
    Security Directorate, the Defence Ministry, the Border Police and the Passenger
    Railway Corporation (CFR).




    SCHOOLS Students
    resumed classes on Monday in the third module of the academic year in
    Romania. The next school holiday is to be decided by county inspectorates and
    most likely will kick off on February 19th. In another development, against the
    background of a new wave of respiratory infections, medical authorities are
    urging parents not to send their children to school if they show any symptoms
    of a respiratory disease.




    TENNIS Romanian
    tennis player Ana Bogdan on Monday qualified for the round of sixteen of the
    WTA 500 tournament in Adelaide, Australia with over 900 thousand dollars in
    prize money. The Romanian secured a 6-3, 6-4 win against Katie Boulter of
    Britain. Also on Monday the all-Romanian pair Ana Bogdan/Monica Niculescu was
    defeated by the US-Dutch pair Asia Muhammad/Demi Schuurs 7-6, 6-4 in the

    RAINFALLS New code orange and code yellow alerts for heavy rainfalls, storms and flash floods have been issued in Romania for most of the Romanian territory, except for the north-west. Hydrologists have also warned against possible flooding along 11 rivers until Monday night. Thousands of households were flooded or left without electricity following recent heavy rainfalls in Romania. According to the Inspectorate General for Emergency Situations, 49 towns and villages and the capital city were affected, with firefighters moving in to pump out the water in several households, over 100 yards and scores of streets in Bucharest alone. The wind caused several trees to fall over parked vehicles, and road traffic was also disrupted.



    COVID-19 The number of new Covid-19 cases
    in Romania
    continues to drop, with 63 new infection cases reported on Saturday, and 164 patients
    in intensive care. Hospitals are gradually resuming their regular activity and,
    according to some managers, they are better prepared for a possible surge in
    cases. Meanwhile, experts warn against the risk of a 4th wave of the
    coronavirus pandemic in Romania. The health minister Ioana Mihăilă said the Indian
    strain of the SARS-CoV-2 virus may come to prevail in Romania as well, which is
    why it is all the more important that as many people be immunised. According to Romania’s representative in the World Health
    Organisation Alexandru Rafila, with the current vaccination trend, only 7
    million people at most will have been immunized by autumn, which is below the
    authorities’ target. Some 25,500 people received the vaccine in the past 24
    hours. So far over 8.7 million Covid-19 vaccine doses have been administered in
    Romania, with nearly 4.35 million people having received both doses of vaccine.



    DEFICIT The EUs Economic and Financial Council extended to 2024 the deadline for Romania to put an end to the excessive deficit situation. The Council said that an extension to the original deadline for Romania to correct its public deficit would be important in order not to compromise the economic recovery after the COVID-19 pandemic. The recommendation also says that, in order to meet the new deadline, Romania would need to achieve a general government deficit target of 6.2% of GDP next year, 4.4% of GDP in 2023, and 2.9% of GDP in 2024. Romania is expected to present the European Council with a report on its strategy regarding these targets by 15 October, the Romanian Finance Ministry announced.



    ACCIDENT At least 3 workers, one of them from Romania, died when a school under construction partly collapsed in Antwerp, Belgium, AFP reports. Nine others were injured in the incident on Friday afternoon. The school was still under construction, so no students were present.



    OECD The Romanian foreign minister Bogdan Aurescu reconfirmed Romanias commitment to join the Organisation for Economic Cooperation and Development as soon as possible. Aurescu had a meeting on Saturday with the organisations new secretary general, Mathias Cormann, on the sidelines of the Diplomatic Forum in Antalya (Turkey). On the same occasion, the Romanian diplomat discussed the Black Sea security situation with his Ukrainian counterpart Dmytro Kuleba.



    IRAN Hardliner Seyyed Ebrahim Rais al-Sadati won Fridays presidential election in Iran from the first round, with over 62% of the votes, according to preliminary results made public on Saturday. A former magistrate, the Conservative al-Sadati is close to Ayatollah Ali Khamenei, Reuters comments. The new president will have to resume the negotiations started in Vienna for the restart of the 2015 deal regulating the countrys nuclear activities.



    TENNIS Horia Tecău (Romania) / Kevin Krawietz (Germany) qualified into the doubles final of the tennis tournament in Halle (Germany), ATP 500, after defeating the Belgians Sander Gille / Joran Vliegen, 7-6, 7-5. Tecău and Krawietz are playing their 3rd final this season, after having lost the ones in Rotterdam and Barcelona. Also in tennis, the Romanians Monica Niculescu and Elena Gabriela Ruse Friday qualified into the doubles final of the ITF tournament in Nottingham (UK).     Coronavirus – 1.679
    nouveaux cas d’infection par le SARS-CoV-2 ont été enregistrés en Roumanie en
    24 heures, a informé jeudi le Groupe de communication stratégique. Le nombre
    total de personnes infectées s’élève à présent à 108.690. Le bilan tragique de
    la pandémie de Covid-19 s’est alourdi avec 27 nouveaux décès enregistrés en 24
    heures, la Roumanie déplorant actuellement 4.312 victimes du nouveau
    coronavirus. 11.540 personnes positives au SARS-Cov-2 sont isolées à domicile
    et 5.807 autres sont placées en isolement institutionnalisé. 38.167 personnes
    sont mises en quarantaine à domicile et 7 autres en quarantaine
    institutionnalisée. A l’étranger, 6.599 ressortissants roumains ont été
    dépistés positifs au nouveau coronavirus et 126 en ont perdu la vie.




    Missiles – Le premier système de missiles Patriot de défense aérienne est
    entré, ce jeudi, dans la dotation de l’Armée roumaine. La cérémonie de
    réception a eu lieu sur le polygone du Cap Midia (sud-est de la Roumanie), en
    présence du premier ministre, Ludovic Orban, du ministre de la défense, Nicolae
    Ciucă, et des représentants des deux compagnies américaines productrices. Les
    principaux équipements qui composent le système de missiles sol-air Patriot ont
    commencé à arriver en Roumanie en août dernier. La Roumanie a signé avec deux
    compagnies américaines, il y a deux ans, un contrat d’achat de sept batteries Patriot,
    pour un montant de 3,9 milliards de dollars. Quatre d’entre elles seront
    attribuées aux forces de l’air et trois aux forces terrestres.

    Militaire – Le commandant de la Mission multidimensionnelle intégrée des Nations unies pour la stabilisation au Mali (MINUSMA), le général Dennis Gyllensporre, a rencontré les militaires roumains du détachement « Carpathian Pumas », déployé au Mali, a informé jeudi le ministère de la défense de Bucarest. Le commandant de la MINUSMA s’était entretenu, mercredi, avec les membres du contingent roumain au sujet de leurs missions sur place. A cette occasion, il a apprécié la contribution apportée par le détachement d’hélicoptères roumain aux opérations de la MINUSMA durant cette année, à travers les quelque 280 missions exécutées. La Roumanie contribue, depuis octobre 2019, durant un an, aux efforts internationaux de maintien de la paix au Mali avec un détachement des Forces de l’air, composé de 120 hommes et 4 hélicoptères IAR-330 Puma L-RM.






    Gazoduc – L’ouverture des travaux au gazoduc sous-marin du Projet de développement gaz naturels Midia (MDG) représente un pas important fait pas la Roumanie, qui s’assure ainsi d’être, probablement, le premier pays à extraire des gaz naturels de la mer Noire, a déclaré, jeudi, le ministre roumain de l’économie, de l’énergie et du milieu des affaires, Virgil Popescu. Il a assisté jeudi à l’inauguration officielle des travaux de construction du gazoduc. Y ont été également présents le premier ministre Ludovic Orban et l’ambassadeur des Etats-Unis à Bucarest, Adrian Zuckerman.A cette occasion, le ministre Virgil Popescu a affirmé que l’exploitation des gaz naturels de la mer Noire a été, est et continuera d’être une priorité du gouvernement roumain. Le MGD est le premier projet de développement des gaz naturels du plateau continental roumain de la mer Noire à être construit après 1989. Il a la capacité de fournir dans une première étape 10% de la consommation de gaz naturels de la Roumanie.

    Economie – En Roumanie, les constructions ont enregistré une hausse de
    12,2%, en juillet 2020, par rapport au même mois de l’année passée, la
    progression la plus importante enregistrée parmi les Etats membres de l’Union
    européenne, indiquent les chiffres rendus publics par l’Office européen de la
    statistique (Eurostat). Dans la zone euro, également en juillet, les
    constructions ont connu un déclin annuel de 3,8%, tandis que sur l’ensemble de
    l’UE, la baisse a été de 3,9%. Selon Eurostat, les seuls Etats membres à
    afficher des chiffres à la hausse dans le secteur des constructions en juillet
    ont été la Roumanie et la Finlande (2,5%). La baisse la plus importante s’est
    produite en Hongrie (moins 21%), en Slovaquie (moins 15,4%) et en Pologne (moins
    11%).









    Météo – Une alerte
    jaune aux vents forts est en vigueur dans 10 départements de la Roumanie de
    jeudi soir à vendredi après-midi. Les températures baisseront notamment dans
    le nord et le nord-est du pays. Vendredi, les températures se situeront entre 18° et 28°.

    Covid-19 1,679 new cases of people infected with SARS-CoV-2 were reported in Romania, following tests performed at national level, the Strategic Communication Group announced on Thursday. The total number of infections has thus reached 108,690. Another 27 coronavirus-related deaths were also reported, taking the death toll so far to 4,312. 460 patients are in intensive care, the Group has also reported. In Romania, 11,540 people confirmed with the new coronavirus are in isolation at home, and 5,807 are in institutional isolation. Also, 38,167 people are in quarantine at home, and 7 in institutionalized quarantine. Of the Romanians living abroad, 6,599 have so far tested positive for COVID-19, and the number of deaths stays at 126.



    Pandemic 30 million infections and 945,000 deaths have been reported worldwide, according to worldometers.info. The United States is the hardest hit by the Covid-19 pandemic, with more than 6,800,000 infections and more than 200,000 deaths. In the United Kingdom, the European country with the highest number of deaths, over 41,000, the health system can no longer cope with the demand for tests, and the government has announced that it will rationalize them for the time being. Spain has exceeded 600,000 cases and 30,000 deaths. As of Friday, Israel becomes the first country in the world to apply the lockdown measure for the second time, due to the very large number of new cases of COVID-19.



    Elections. In Romania, the electoral campaign for the local elections due on September 27 continues, in conditions meant to prevent infections with the new coronavirus. According to the Ministry of Interior, wearing a protective mask is mandatory, and for all persons participating in electoral events or meetings, observational triage and mandatory hand disinfection will be performed. The rules of access and personal protection will be displayed in visible places. A physical distance of at least one meter between participants will be ensured, including for actions carried out on the street or from door to door. A maximum of 50 people will attend the events and meetings held indoors, and the duration will be limited to a maximum of two hours. In the case of events and meetings held outdoors, the organizers must ensure that the number of participants is limited to a maximum of one hundred. 41 county council presidents, about 3,200 mayors, over 1,300 county councillors and 40,000 local councillors will be elected. Election had been scheduled for June, but was postponed due to the pandemic, and local elected officials have extended their terms by half a year.



    Constructions Construction works in Romania saw a 12.2% increase in July 2020 compared to July 2019, which is the biggest increase for this industry in the EU, the European Statistics Office (Eurostat) announced on Thursday. July is the 3rd consecutive month with Romania as an EU leader in terms of the growth of the constructions industry. In the Eurozone, this sector reported a 3.8% year-on-year decline this July, whereas in the EU the drop rate was 3.9%. According to Eurostat, the only EU member states where the constructions industry grew in July were Romania and Finland (2.5%), with the most dramatic falls reported in Hungary (-21%), Slovakia (-15.4%) and Poland (-11%).



    Missiles The first Patriot missile air defence system was received today by the Romanian Army, in a ceremony held in Capul Midia (south-east), in the presence of PM Ludovic Orban, the defence minister Nicolae Ciucă, and officials of the American producer. The main components of the Patriot system arrived in Romania last month. Two years ago, Romania signed an agreement on the purchase of 7 Patriot batteries for 3.9 billion USD, from 2 American companies. Four of them will be used by the Romanian Air Forces, and the other 3 by the Land Forces.



    Natural gas With the start of works on the submarine pipeline of the Midia Natural Gas Development Project (MGD), Romania has taken a major step in making sure it will probably be the first country to extract natural gas from the Black Sea, the minister of economy, energy and business environment Virgil Popescu said on Thursday. He attended the official start of works on the pipeline, an event in which PM Ludovic Orban and the US Ambassador Adrian Zuckerman also took part. Popescu pointed out that for the Romanian Government, developing the Black Sea natural gas has been and will remain a priority. “Today we see an important step taken in this project, an American investment of over 500 million euros, he added. MGD is the first project tapping Romanias offshore gas reserves in the Black Sea to be launched since 1989. In a first stage, it will be able to cover 10% of Romanias gas needs.

    Tennis The Romanian tennis player Simona Halep, number 2 in the world, plays
    on Friday against Dayana Yastremska of Ukraine (29 WTA) in the 8th-finals
    of the WTA tournament in Rome. Another Romanian, Irina Begu (77 WTA) was
    kicked out of the competition on Thursday by Britain’s Johanna Konta (13 WTA). Also on Thursday, in the doubles, Romanians
    Simona Halep and Monica Niculescu lost the 8th-finals to the
    Japanese Shuko Aoyama and Ena Shibahara. Raluca Olaru (Romania) and
    Anna-Lena Friedsam (Germany), are playing on Friday against Magda Linette (Poland)
    andBernarda Pera (USA), in the quarter-finals of the Premier 5

    WEATHER– After snowstorms at the weekend, Romania is facing a cold snap until Thursday, meteorologists say. On Wednesday, temperatures will drop to minus 25 degrees Celsius, whereas the highs of the day will not exceed plus 2 degrees Celsius. In another move, railroad traffic is further disrupted in the south and southeast of the country, the areas the most affected by heavy snowfalls and blizzard at the weekend. Several villages have been left without electricity.



    DIPLOMACY – Romanian Prime Minister, Dacian Ciolos, will pay a two-day official visit to Paris, as of Wednesday. He is due to meet President Francois Hollande, Prime Minister Manuel Valls, and the speakers of the two Chambers of the French Parliament, Gérard Larcher and Claude Bartolone, respectively. The talks will focus on the privileged relations between Romania and France, on stepping up the projects in the roadmap of the bilateral strategic partnership, on improving economic relations and strengthening contacts between the business communities, as well as important topics on the European and international agenda, such as terrorism, migration and the EU security policy. Other focal points of the talks will include Romanias Schengen accession, the forthcoming report of the European Commission under the Cooperation and Verification Mechanism, as well as cooperation as part of Bucharests preparations to take over the presidency of the EU Council. Ciolos will also meet with representatives of the Romanian community in France and with CEOs and managers of important French companies. France is the fifth largest foreign investor in Romania.



    SPECIAL PENSIONS – Romanias Constitutional Court on Wednesday will debate the notification submitted by the technocratic cabinet in Bucharest on the special pensions law for elected local officials. According to the government, the law adopted in December would run counter to several articles in the Constitution, by instating a special regime of privileges for certain elected local officials. Furthermore, the government contests the retroactive granting of special rights and draws attention to the lack of budget resources. Over 16,000 potential beneficiaries, mayors, deputy mayors, presidents and vice-presidents of County Councils, are to receive special pensions ranging from 350 to1,500 Euros.



    ECONOMY– Romania is the third EU member state to register, in November 2015, the most significant increase in the volume of construction works, as compared to the same period of 2014. According to the data released on Tuesday by the European Statistics Office, Eurostat, Romania registered an increase of 6.8%, being outclassed only by Slovakia and Sweden. In November 2015, the volume of construction works at EU level increased by 1.9%, on an average, Eurostat also shows.



    SPORTS – The Romanian player Alexandra Dulgheru (no. 61 WTA) has qualified to the second round of the Australian Open, the first Grand Slam tournament of the year, after defeating the Australian Storm Sanders (no. 355 WTA) 6-4, 6-2. Three other Romanian players lost their games in the first round. World no. 2 Simona Halep was surprisingly defeated by Chinas Shuai Zhang (133 WTA), Irina Begu (31 WTA) was outperformed by the Swedish Johanna Larsson (50 WTA), and Andreea Mitu (96 WTA) was defeated by the German Julia Gorges (45 WTA). Another Romanian player, Monica Niculescu (no 40 WTA), qualified on Monday to the second round of the tournament, and is to play against the Russian Elizaveta Kulicikova (no 109 WTA).

    La compagnie de conseil et d’audit PricewaterhouseCoopers Roumanie s’attend cette année à des investissements significatifs dans le domaine immobilier et à la relance de la construction, notamment à Bucarest, Timişoara et Cluj-Napoca, les investisseurs ayant témoigné en 2014 d’un appétit accru pour le secteur immobilier. « En 2014 on a enregistré un grand nombre de transactions visant des propriétés – aussi bien pour le secteur des bureaux que pour celui commercial. En 2015, nous nous attendons à des investissements importants dans ce secteur» – déclarait la représentante de PricewaterhouseCoopers, Francesca Postolache, dans un communiqué. En Roumanie, la valeur des transactions immobilières a progressé de 300 millions d’euros en 2013 à 1,2 milliards d’euros en 2014.

    Selon DTZ Echinox, 45% de ces transactions représentent des acquisitions de projets dans le domaine du commerce de détail, 30% des bureaux, le secteur industriel, lui, a attiré 15% des transactions, celui des terrains 10%. La compagnie estime que le marché des investissements continuera à progresser pendant les années à venir.

    Le président de l’Association des courtiers immobiliers de Roumanie, Dragoş Vlăsceanu, explique: « En 2014, nous avons enregistré le plus grand nombre de transactions immobilières de l’histoire – soit près de 850 mille contre 700 mille en 2007. 2014 a été une année de pointe, de boom immobilier. Du point de vue de la dynamique, les transactions ont progressé de 20% par rapport à notre meilleure année – à savoir 2007. »

    Une légère hausse des prix commence à se faire jour sur le marché. Dragoş Vlăsceanu: « Aucun des paramètres pouvant influencer les prix ne semble suggérer que ceux-ci vont baisser. Au contraire, la demande est croissante, car les gens choisissent, pour la plupart, de retirer leur argent des banques pour acheter des propriétés, qui représentent en ce moment l’investissement le plus rentable. La situation économique et financière sur le marché encourage l’achat de propriétés immobilières. Le gouvernement lui-même stimule et influence l’achat de logements, par la poursuite du programme « Premier logement ». En 2015, les fonds destinés à ce programme sont les plus grands alloués jusqu’ici, car on constate que la demande est en hausse. »

    Dragoş Vlăsceanu s’est également rapporté à la construction de maisons de vacances : « Les Roumains n’ont pas récupéré à tel point pour penser à s’acheter une maison de vacances. Aussi, le nombre de personnes qui se le permettent est-il encore plutôt réduit. Le marché est toujours bloqué. En échange, les locations vont bon train – sauf en banlieue, car la distance à parcourir implique des coûts supplémentaires. Les gens cherchent des appartements à louer dans les agglomérations urbaines, dans les zones où le réseau de transport en commun est très développé – notamment le métro. Les ventes vont, elles aussi, bon train. Pourquoi ? Parce que le prix du mètre carré a baissé jusqu’à 700 euros environ. »

    Selon le portail imobiliare.ro, à l’échelle nationale, au mois de mai le prix moyen sollicité pour les appartements mis en vente était de 928 euros le mètre carré, un chiffre supérieur de 0,8% par rapport à la même époque de l’année dernière. A Bucarest, pour la même période, les prix ont baissé en moyenne de 2,3%, jusqu’à la 1.056 euros. En échange, les vieux appartements ont été plus chers de 0,7%, étant vendus contre 1.031 euros le mètre carré. A Braşov, les prix moyens ont augmenté, au mois de mai, de 6,1%, jusqu’à 855 euros le mètre carré, tandis qu’à Cluj-Napoca, les prix ont progressé de 863 à 1.011 euros le m2. A Constanţa, selon Imobiliare.ro, le prix a atteint 900 euros le m2, progressant de 4,2% par rapport à mai 2014. A Timişoara, les vendeurs demandent 875 euros par m2, soit 8,2% de plus par rapport à l’année dernière.

    Selon l’agence roumaine de presse Mediafax, Joseph Houlihan, président du Comité directeur de European Property Federation, a récemment affirmé qu’en Roumanie le marché de l’immobilier était en hausse, suscitant de plus en plus l’intérêt des entrepreneurs et des investisseurs en raison des rendements qu’il offre. « Le marché roumain de l’immobilier offre à présent aux investisseurs les plus grands rendements d’Europe centrale et orientale, soit environ 8%, alors que les propriétés similaires de Varsovie et de Prague offrent des rendements de 6,5% tout au plus » – affirme Joseph Houlihan.

    Fiscalité et milieu d’affaires

    2014 est venu avec de nouvelles taxes et des modifications à l’égard des impôts. Il s’agit, surtout, de la taxe sur les constructions spéciales, l’ainsi dite « taxe sur le poteau » qui représente un taux de 1,1% de la valeur comptable brute des constructions spéciales le 31 décembre de l’année antérieure, la valeur comptable brute étant le montant primitivement inscrit dans la comptabilité des compagnies, sans prendre en compte les amortissements qui diminuent graduellement, chaque année, la valeur des constructions spéciales.



    L’analyste économique Constantin Rudnitchi estime que : “Nous avons quelques nouveaux impôts en vigueur dans l’économie roumaine et dans la fiscalité roumaine et, en ce sens, je pense, en premier chef, à l’impôt sur les constructions spéciales. C’est une année pendant laquelle les redevances augmentent ou sont re-discutées. C’est une année pendant laquelle les accises sont calculées d’une autre manière et, c’est déjà certain, elles ont augmenté. Or, tous ces éléments peuvent faire que les produits roumains soient moins compétitifs à l’extérieur. Les coûts des compagnies augmentent et la compétitivité baisse”.



    A son tour, le consultant fiscal Dan Schwartz parle, pour Radio Roumanie, de la nouvelle taxe sur les constructions spéciales : “Celle-ci n’a aucune justification économique, surtout qu’elle a été conçue comme un impôt collecté au budget de l’Etat et non pas comme une taxe locale. La collecte au budget de l’Etat ne fait rien d’autre qu’accroître le taux effectif d’impôt lorsqu’il s’agit de l’impôt sur le profit. Dans la zone des modifications en 2014, on peut aussi parler de la nouvelle modalité de calculer en général les accises, ce qui va également accroître le coût de l’accise et, dans la zone des impôts pour les personnes physiques, on introduit l’obligation de calculer la contribution pour l’assurance santé pour les revenus obtenus des loyers”.



    Pour sa part, le président de la Fédération Patronale du Tourisme et des Services, Dan Matei Agaton, a déclaré : “Toute taxe supplémentaire, soit fiscale, soit parafiscale, veut dire baisse économique et non pas croissance économique et veut dire chômage, l’idée que les accises sur les combustibles ne voudraient pas représenter la hausse des accises mais le changement du système de calcul compte tenu du taux de l’inflation et non pas selon le taux de change leu-euro. Nous n’avons pas pourquoi être d’accord à la hausse des taxes. Déjà, l’économie roumaine est para-fiscalisée. Le fait qu’on trouve des modalités différentes de hausse des taxes selon la façon de calculer, soit la taxe sur le pilier, soit sur les petites constructions, soit sur le type de garage ou je ne sais pas quoi, ne fait qu’alourdir la marche de l’économie. Le risque serait de dépasser la cible d’inflation qui est, maintenant , sous contrôle, tant bien que mal. Or, si nous excédons la cible d’inflation, nous excédons les engagements avec le FMI. »



    A partir du 1-er avril, une accise supplémentaire de 7 centimes d’euro sera appliquée aux carburants, accise qui ne jouit pas de l’appui du président roumain Traian Bàsescu. Selon le président, cette hausse d’accise n’est pas nécessaire car les montants qui pourraient en venir au budget pourraient être couverts par la diminution d’autres dépenses. Pour leur part, les représentants de l’Exécutif disent soutenir un paquet de relaxation fiscale et de développement économique comprenant la baisse des contributions aux assurances sociales et l’exemption d’impôts sur le profit re-investi. Toutes ces mesures seront discutées avec les représentants de la Commission Européenne, du Fond Monétaire International et de la Banque Mondiale lors de leur visite en Roumanie qui aura lieu au mois d’avril prochain.



    Voici les propos en ce sens du premier ministre Victor Ponta : “Les choses ont bien évolué en 2013, coté croissance économique, coté déficit et coté absorption des fonds européens et alors, de toute évidence, nous pouvons continuer en 2014 les mesures pour stimuler, d’une part, les équilibres sociaux, les retraites, les salaires et, d’autre part, au bénéfice de l’industrie privée. La hausse des exportations et celle de la production industrielle ont eu une grande importance. Nous nous trouvons dans la même tendance croissante. Lorsque les choses vont bien, évidemment, nous pouvons nous permettre continuer de telles mesures. Nous avons également constaté qu’en 2013 les investissements se sont accrus. Donc, l’exemption d’impôts du profit re-investi est un des objectifs réalisables. »



    L’analyste économique Aurelian Dochia, lui, fait preuve de précaution : “Actuellement, tout mouvement se fait en assumant une grande dose de risque puisque, si le gouvernement tente d’intervenir maintenant avec des mesures pour stimuler la consommation, ce qui veut dire soit des diminutions de fiscalité, soit des hausses de revenus pour certaines catégories par toutes sortes de transferts, il pourrait, plus tard, se trouver devant des problèmes en matière d’exécution budgétaire et avoir sur les bras un déficit budgétaire accru. Si la croissance n’est pas assez grande pour créer l’espace fiscal au niveau du budget, ces mesures, probablement, ne pourraient pas être prises”.



    En conclusion, remémorons ce qui s’est passé en 2013 dans le domaine de la fiscalité. Le Code Fiscal a été modifié très souvent sans avoir un impact significatif sur le milieu d’affaires mais c’est justement le grand nombre de modifications a été critiqué par les consultants fiscaux.



    L’expert fiscal Dan Schvartz parle, également, d’une modification dont l’impacte a été négatif sur les PME : “Ce fut la première année pendant laquelle on a appliqué l’ainsi dite TVA à l’encaissement. Ceci a engendré des problèmes pour le milieu d’affaires compte tenu de la nécessaire adaptation des systèmes comptables, des systèmes informatiques, des exigences imposées par l’application de la TVA à l’encaissement qui est un système bureaucratique. Il y a eu des compagnies qui se sont trouvé dans la situation de fermer leurs portes pour avoir perdu des contrats importants conclu avec des contribuables qui n’avaient pas l’obligation de payer la TVA à l’encaissement. Il y a une multitude de modifications qui sont de nature technique en 2013 et qui ont eu des implications négatives pour le milieu d’affaires. Mais le pire effet a été celui de l’instabilité de la législation fiscale, ces changements fréquents”.



    L’obligation du système d’appliquer la TVA à l’encaissement a été éliminée depuis le début de l’année courante, les firmes pouvant appliquer ou non un tel système. (trad.: Costin Grigore)
