    Romania supports the territorial integrity of Ukraine

    After
    Russia’s withdrawal last month from an agreement allowing Ukraine to export its
    agricultural production, which is crucial for the world food security, the
    repeated Russian bombardments against Ukraine’s maritime and river ports have
    led to the destruction of over 270 thousand tons of grain, authorities in Kyiv have
    announced.




    Only
    the bombing of the Danube port of Ismail on Tuesday night for instance wiped
    out 13 thousand tons of cereals, the Ukrainian Minister of Infrastructure,
    Oleksandr Kubrakov has said. Several grain terminals and private storehouses

    Bucharest

    The Constitutional Court and proposals to revise the fundamental law

    On May 26, a large majority of Romanians voted to ban amnesty and pardon for corruption offences, and to deny the government the right to issue emergency orders in the field of the judiciary. On the same occasion, they agreed to allow other institutions apart from the Ombudsman to challenge the constitutionality of such emergency orders. The referendum in which citizens were asked for their view on these matters had been called by President Klaus Iohannis, who sought to put an end to what he called the offensive of the ruling coalition made up of the Social Democratic Party and the Alliance of Liberals and Democrats against the judicial system.



    Following the referendum, political parties, both in power and in opposition, came up with bills revising the Constitution as desired by the people. But on Thursday, the Constitutional Court dealt a heavy blow to these attempts to alter the fundamental law. Although it had ruled that the referendum on this topic was constitutional, the Court now found that proposals to prohibit amnesty and pardon for corruption offences are unconstitutional. The Court says the measure comes against the principle of equality before the law and would amount to a violation of human dignity. Decisions with respect to amnesty and collective or individual pardons should remain in the hands of parliament and of the president of the country, respectively, and a comprehensive and permanent prohibition from granting amnesty and pardon for certain crimes cannot be introduced, the judges claimed.



    On the other hand, other proposals included in the bills tabled by Power and Opposition are within constitutional limits, the Court says. These include a provision under which citizens serving final sentences for offences committed knowingly and willfully are not allowed to run in parliamentary, local, presidential and European elections. Also, the excessive resort to emergency government orders can be prevented, with such orders subject to constitutionality checks at the request of the president of the country, of the supreme court, of 50 Deputies or 25 Senators or of the Ombudsman.



    The National Liberal Party in Opposition sees these Constitutional Court rulings as surprising, given that millions of Romanians voted to prohibit amnesty and pardons for corruption offences on May 26. The Liberal leader Ludovic Orban advised the ruling coalition not to take political advantage of the Courts decision. On the contrary, the head of the Alliance of Liberals and Democrats Calin Popescu Tariceanu says Thursdays decision of the Constitutional Court invalidates the Presidents move to make amnesty and pardon for corruption crimes illegal, and urged Klaus Iohannis to resign immediately and unconditionally, on grounds that he lured citizens into a reckless exploit.

    Acquis – La Roumanie a reçu jeudi plusieurs sollicitations de la part de la Commission européenne dans différents domaines où Bruxelles a remarqué une violation partielle de l’acquis communautaire. Les autorités roumaines disposent de deux mois pour remédier à la situation, sinon la Commission européenne peut assigner Bucarest devant la Cour Européenne de Justice. Ainsi, Bruxelles a-t-il sollicité aux autorités roumaine de mettre en place de nouvelles directives relatives aux émissions industrielles. Une deuxième sollicitation porte sur le calcul final des tarifs de production et deux autres concernent le système des taxes. La Commission a appelé la Roumanie à modifier les règles de taxation dans le cas des salariés non-résidants qui ne peuvent pas bénéficier de frais déductibles et à élaborer une procédure plus rapide de remboursement de la TVA aux compagnies et aux entrepreneurs. Au chapitre justice, la Roumanie se verra contrainte de mettre en place la directive concernant l’égalité des chances hommes/femmes.



    Schengen – Les conditions dentrée de la Roumanie et de la Bulgarie dans lespace Schengen de libre-circulation des personnes en Europe ne sont “pas réunies”, a déclaré jeudi la porte-parole du gouvernement français, en pleine polémique sur les Roms. “La France nest pas la seule à dire non aujourdhui”, a précisé Najat Vallaud-Belkacem. Cette déclaration survient à celle faite par le ministre français de l’Intérieur, Manuel Valls qui déclarait il y a quelques jours que “les nombreux délits attribués aux Roms et que les autorités françaises n’arrivent pas à tenir sous contrôle déboucheront sur le refus de la communauté Schengen d’ouvrir sa porte à la Roumanie”. En réplique, le premier ministre roumain, Victor Ponta, a estimé jeudi, à Bucarest, “quil ny avait pas de lien” entre la question des Roms en France et lentrée du pays dans Schengen.



    Pourparlers – Le Partenariat stratégique, l’inclusion de la Roumanie dans le programme Visa Waiver et la nomination des ambassadeurs roumain et américain ont dominé les discussions que le chef de la diplomatie roumaine, Titus Corlatean, a eues avec le secrétaire américain d’Etat, John Kerry, en marge de l’Assemblée générale de l’ONU de New York. Et Corlatean d’ajouter que Washington a donné officiellement son accord sur la nomination de Iulian Buga au poste d’ambassadeur de la Roumanie à Washington. Par ailleurs, le ministre roumain des Affaires Etrangères a tenu évoquer “l’intérêt accru” des multinationales américaines envers la Roumanie. Une délégation des hommes d’affaires américains visitera Bucarest en novembre.



    Justice – L’ancien parlementaire, Dan Voiculescu, président fondateur du Parti Conservateur a été condamné jeudi à 5 ans de prison ferme pour blanchiment d’argent dans le dossier de la privatisation frauduleuse de l’Institut de Recherches Alimentaires. Sur les 8 autres personnes condamnées dans ce même dossier on retrouve Gheorghe Mencinocopschi, ancien directeur de l’Institut et Sorin Pantis, ancien ministre des Télécommunications, les deux condamnés à six ans de prison. Le préjudice s’élève à 60 millions d’euros et la sentence n’est pas définitive.



    Livre – Présente au Salon du Livre de Göteborg, en Suède, la romancière roumaine, Ioana Parvulescu, s’est vu remettre jeudi le Prix Européen pour la Littérature pour son roman La vie commence vendredi”. La distinction qui recompense les jeunes talents européens lui a été remise par la commissaire européenne à l’Education, à la Culture et au Multilinguisme, Androulla Vassiliou. 11 écrivains présents à l’événement se sont vu récompenser de cette distinction. Pour la deuxième fois cette année, la Romanie participe en tant qu’invitée d’honneur à un prestigieux Salon international du livre, après celui de Paris, organisé au printemps dernier. L’écrivain Mircea Cărtărescu, un des auteurs roumains les plus connus et traduits à l‘étranger, a inauguré jeudi la Foire du livre de Göteborg. A son avis, la présence à ce salon international du livre, qui compte parmi les plus renommés d’Europe, est un honneur pour les écrivains roumains.
